Terms Of Use.
1. Acceptance of Terms
These Terms and Conditions govern your access to and use of the website “ElevateCareNP” (the “Platform”), as well as any professional services provided by Sharon Reif, NP, via telephone, email, or in-person, regardless of whether those services were initiated through the Platform or via direct contact (e.g., business card, referral, or direct dial). If you do not agree to be bound by these Terms of Use and our Privacy Policy, you are not authorized to access our services. For patients engaging via telephone or direct contact, your verbal consent to proceed with a consultation and/or your act of providing payment constitutes your full acceptance of these Terms.
2. Eligibility & Massachusetts Medical Cannabis Law
By engaging ElevateCareNP, you expressly acknowledge that these services are solely for qualified patients residing in Massachusetts who are 18 years of age or older.
Age Requirements: You must be at least 18 years of age.
Patients aged 18–20: As a condition of service, you are generally required to provide medical records documenting a qualifying diagnosis prior to your consultation. However, Sharon Reif, NP, reserves the right to waive medical record requirements on a case-by-case basis at her sole professional discretion.
Legal Acknowledgment: You assume full responsibility for complying with Massachusetts law. You acknowledge that cannabis remains illegal under federal law and that ElevateCareNP provides no legal protection regarding federal, civil, or criminal proceedings.
3. Service Provided - No Medical Care or Advice
ElevateCareNP is not a medical group and does not provide general medical treatment. The Platform and Sharon Reif, NP, provide a specialized service for the specific purpose of medical marijuana certification. This relationship does not replace the care provided by your primary physician or other healthcare professionals.
4. Consent to Electronic Communications, Marketing, and Telehealth
By providing your mobile number and/or email address, you expressly consent to be contacted by or on behalf of ElevateCareNP for:
Service & Clinical Communications: Appointment reminders, certification status, and clinical updates.
Marketing & Promotions: Information regarding new services, products, or educational content via email and text message (SMS/MMS). You may opt-out at any time by replying "STOP" to texts or "Unsubscribe" to emails.
Telehealth Modalities: You expressly consent to healthcare evaluations conducted via telephone (audio-only) or video conferencing.
Acknowledgment of Risk: While we use HIPAA-compliant platforms for formal records, the security of communication via standard telephone lines or cellular networks cannot be guaranteed 100% against interception. You accept these risks by electing to communicate through these channels.
5. Not for Emergencies
Our services are not for medical emergencies. If you are experiencing an emergency, call 911. Never disregard professional medical advice or delay seeking it because of information provided during a consultation.
6. Risk of Telehealth Services
You acknowledge potential risks of telehealth (video, phone, or messaging), including:
Audio/visual information may be insufficient for a complete assessment;
Failures of electronic equipment or security protocols;
Lack of access to your full medical history may lead to adverse interactions or judgment errors.
7. Payments, Cancellation, and Refunds
Payment is required at the time of booking or prior to the consultation.
Billing Descriptor: You acknowledge that the charge will appear on your credit card or bank statement as "ElevateCareNP".
Refund Policy: If you are not issued a certification after your visit with Sharon Reif, NP, you will be issued a full refund.
8. Certification Policy
Certification is not guaranteed. It is only issued if Sharon Reif, NP, determines it is appropriate following a clinical evaluation. Any certification acquired is for your personal use only.
9. Limitation of Liability and Governing Law
To the maximum extent permitted by law, ElevateCareNP’s total liability to you is limited to the amount paid for the service. These Terms are governed by the laws of the Commonwealth of Massachusetts.
10. Revisions
ElevateCareNP reserves the right to revise these Terms at any time. For patients not using the website, the most current version of these Terms is available at elevatecarenp.com.
